1. About The SimulationScore

These Terms of Use (the "Terms") govern your access to and use of the website and services operated by The SimulationScore ("we", "us", "our"), including our site where people submit unusual stories (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Who Can Use the Service

  • Age requirement: You must be at least 18 years old, or the age of majority in your jurisdiction, to submit content.
  • No accounts: We do not require you to create an account or provide your name or email to submit a story.
  • Location: You are responsible for ensuring that using the Service is legal where you live.

3. User-Submitted Stories

Our Service allows you to submit text stories and related content (collectively, "Stories").

  • No real names or identifying information: You agree not to submit real names, email addresses, phone numbers, or other information that can reasonably identify yourself or other real people.
  • Ownership: You retain any copyright and other rights you have in your Stories.
  • License to us: By submitting a Story, you grant The SimulationScore a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, edit, translate, create derivative works from, publish, distribute, publicly display, and publicly perform your Story, in whole or in part, in any media now known or later developed, for the purposes of operating, improving, and promoting the Service, including sharing on social media, advertising, and other marketing.
  • Editing and formatting: You agree that we may edit your Story for length, clarity, style, or to remove identifying or inappropriate content, while trying to preserve its spirit.
  • No expectation of publication: We may choose to feature, not feature, remove, or stop displaying any Story at any time, at our sole discretion.

4. Your Responsibilities and Promises

By submitting a Story, you represent and warrant that:

  • Your Story is your own original work, or you have all rights necessary to submit it and grant the license above.
  • Your Story does not infringe any copyright, trademark, or other rights of any person or entity; violate anyone's privacy or publicity rights; contain real names or personally identifying details; or contain illegal, defamatory, hateful, or otherwise unlawful content.
  • You will not use the Service to harass, threaten, or harm others; submit spam or automated content; or attempt to interfere with the Service's security or operation.

5. Our Rights

We may, at our discretion and without notice:

  • Review, moderate, edit, or remove any Story or content;
  • Limit, suspend, or terminate your access to the Service;
  • Modify or discontinue all or part of the Service.

We are not obligated to monitor all Stories but may do so to operate the Service, comply with law, or enforce these Terms.

6. Intellectual Property (Site Content)

Except for user Stories (which you own subject to the license above), all content on the Service—such as text, graphics, logos, design, and software—is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written permission, except as permitted by applicable law.

7. Disclaimers

  • No guarantees: The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
  • We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that all Stories are accurate or truthful. Stories reflect the views of their authors, not necessarily ours.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law:

  • The SimulationScore and our officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service or any Stories.
  • Our total liability for any claim arising out of or relating to the Service or these Terms will be limited to the greater of (a) the amount you paid us (if any) in the 3 months before the event giving rise to the claim, or (b) AUD $75.

Some jurisdictions do not allow these limitations; in those cases, our liability will be limited to the maximum extent permitted by law.

9. Indemnity

You agree to indemnify and hold harmless The SimulationScore and our officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Stories, or your violation of these Terms or any applicable law.

10. Changes to the Service and These Terms

We may update the Service and these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice (for example, on the site). By continuing to use the Service after changes take effect, you agree to the updated Terms.

11. Governing Law

These Terms are governed by the laws of South Australia, Australia, without regard to its conflict of laws principles. Any disputes will be resolved in the courts located in Adelaide, South Australia, unless applicable law requires otherwise.
